Elderly Man Who Complained About Daughters 'Rarely Visiting' Left All Property to Grateful Grandson; Gift Agreement Valid: Aunts
Caregiver Testifies in Court Confirming Property Left to Grandson The judge summoned the caregiver, who testified that she was responsible for the elderly man's care from Monday to Saturday, 9 hours a day, from 2014 until his passing. She mentioned that the elderly man was in good mental condition before his death, able to recognize people clearly and even go to the bank to withdraw money and check stocks. The caregiver revealed that the elderly man often complained about his daughters rarely visiting, but his grandson, Ah Kai, insisted on coming to visit him every week, even while he had to care for his own daughters. The caregiver recalled in detail that on the day of the signing, Ah Kai brought a lawyer to the elderly man's home. He presented a document explaining that it was related to the affairs of the house on Zhonghua Road. The elderly man was fully conscious at the time, chatted happily with his grandson, and personally agreed, "I want to leave the house to my grandson," before signing the document. Judge Rules Contract Valid; Defendants' Heirs Lose Case After considering the statements from both parties and examining the contract, photos, and the caregiver's specific testimony, the judge determined that the elderly man had full legal capacity before his death and signed the gift agreement with the plaintiff while fully conscious. Therefore, the contract was legally valid. The judge ultimately ruled against the defendant heirs according to the Civil Code, ordering them to cooperate in transferring the ownership of the Zhonghua Road property to Ah Kai. As for the elderly man's remaining assets, including land in Xindian District, fractional shares of stock, and scattered deposits in his bank accounts, since the parties could not reach an agreement on division, the court ruled that the Xindian land would be divided among all heirs according to their respective inheritance shares, resulting in joint ownership. The fractional shares and pocket change would be distributed according to the inheritance shares. The case is still subject to appeal according to the law.

The caregiver's specific testimony is indeed crucial for clarifying the truth. The legal recognition of an elderly person's will and capacity often best reflects its original intent in these family disputes.
