藍委推強制鞭打 綠酸「演古裝戲」 民調卻有七成挺
國民黨立委洪孟楷提出《刑法》部分條文修正草案，針對重大性暴力、毒駕、虐童致死致重傷及重大加重詐欺等四類犯罪，增列「強制鞭打」為從刑，數罪併罰最高十二下，未滿十八歲及年滿六十五歲以上者不得執行。此舉源於藍營推動的鞭刑公投遭中選會以違反兩公約為由駁回，遂轉推修法。 民進黨團幹事長莊瑞雄反諷，若只求刑罰威嚇性，「乾脆直接適用大清或明朝刑律」，威嚇性或許更強，但現代社會根本無法接受。他同時質疑，叛國罪、重大經濟犯罪及國會議員犯罪為何未納入鞭刑，批評提案「像在演古裝戲」，並指出鞭刑無助追回被害人損失或瓦解犯罪組織。 行政院發言人李慧芝表示，多數國家認為鞭刑侵害人性尊嚴，違反「兩公約」施行法，須審慎討論。法務部指出，以矯正刑取代應報刑已是現代刑罰趨勢，引進鞭刑恐違反《公民與政治權利國際公約》第7條禁止酷刑之精神。 民調顯示，七成民眾贊成引進鞭刑處罰詐騙犯，民進黨認同者亦有六成六支持。然而，台灣日治時期曾施行笞刑十七年，共約兩萬八千人受刑，已於1921年廢止。鞭刑入法涉及人權保障與犯罪嚇阻之間的權衡，仍需充分公共討論。 不好意思，我也挺鞭刑耶，那位莊幹事說把立委犯罪也列入，我也雙手贊成👌
