Volunteer firefighter fined for speeding en route to late-night fire, appeals overturns initial ruling

A volunteer firefighter captain in Miaoli County was responding to a large fire at a petrochemical plant and warehouse late one night in March. He was caught speeding at 92 km/h in a 50 km/h zone on his large motorcycle, resulting in a fine of 12,000 NTD and a six-month suspension of his license plate. The captain appealed, arguing he was rushing to ensure timely disaster response. However, the motor vehicles office rejected his appeal, stating that his large motorcycle was not an emergency vehicle like a fire truck and therefore subject to speed limits. Consequently, the captain filed an administrative lawsuit. After review, the judge ruled that while his actions didn't fully meet the criteria for 'emergency avoidance' as fire trucks were already on scene, volunteer firefighters have a duty to respond quickly. Considering the immediate and dangerous nature of the petrochemical plant fire, and the fact that it was late at night with sparse traffic, making it unreasonable to expect strict adherence to speed limits, the judge found grounds for 'lack of expectation possibility' and overturned the original ruling. This case highlights the need for legal flexibility for volunteer firefighters during disaster response. It's often a gray area as they frequently use their own vehicles to rush to scenes. Unlike previous cases where volunteer firefighters running red lights were denied leniency, this judge acknowledged the unique circumstances of a volunteer rushing to a high-risk fire late at night, making the verdict particularly significant. The motor vehicles office was lenient on the fine itself but rigid in its stance on appealability. It makes one wonder if this volunteer firefighter will be as willing to drop everything and rush to the next emergency call, knowing they might receive a ticket and have to handle the administrative procedures themselves. 🙄

Public officials must administer the law, so it's difficult to demand that an agency revoke a penalty on its own due to reasons that would preclude liability. It's better to let the administrative court make a judgment on this matter. Unless future legislation explicitly lists circumstances that are not punishable, it's advisable to drive according to the speed limit as much as possible to avoid trouble and ensure your own safety and that of other road users.
