Selling a House to Your Son, Even with His Remittance, Could Still Be Considered a Gift! The National Tax Service Investigates '

If only a portion of the payment can be proven as actually paid, then the part that cannot be proven as actually paid will be handled according to relevant regulations. The actual case will depend on how much proof of payment the parties can provide, whether the source of funds can be verified, and the overall transaction circumstances. If deemed a gift, it's not taxed directly based on the transaction price of 10 million won. While 10 million won is the agreed-upon house price between father and son, even if part or all of the transaction is eventually treated as a gift according to regulations, it doesn't mean the National Tax Service will directly use 10 million won as the value of the real estate gift. According to Ministry of Finance regulations, the value of gifted real estate is generally calculated based on the announced land value at the time of the gift, and for houses, it's based on the assessed housing value. Therefore, you cannot estimate the actual gift tax simply by calculating '10 million won transaction price - 2.44 million won tax-exempt amount.' For gift cases occurring on or after January 1, 2025, gift tax adopts a three-tier progressive tax rate: 10% for taxable net gift amounts up to 28.11 million won, 15% for amounts between 28.11 million won and 56.21 million won, and 20% for amounts exceeding 56.21 million won. The actual amount of gift tax payable still needs to be calculated based on the value of the gifted property, other gifts in the same year, tax exemptions, and legally deductible items. When parents and children buy houses, don't just keep remittance records; complete cash flow is key.

Selling a house to your son may still be considered a gift if he can't prove the remittance! Tax office checks 'where the house

If they can provide proof of the source of funds and actual payment, and the tax office confirms the transaction is genuine, it will be treated as a sale and not considered a gift. Therefore, in addition to the real estate sales contract, title transfer documents, and bank remittance records, the buyer's ability to clearly explain the source of funds is an important proof for real estate transactions between relatives. If a father gave his son 2.44 million won each year in the past, can that money be used to buy the father's house? Another common situation is when parents transfer cash to their children's names over the years, utilizing the annual gift tax exemption limit. In 2026, the current gift tax exemption limit remains 2.44 million won per donor per year. The Ministry of Finance also explained that parents can gift cash to their children using the annual gift tax exemption limit, and children can use these funds for their own investments or property purchases after receiving them. Therefore, funds legally gifted by parents to their children in the past and actually transferred for the children's control can later become the financial source for the children's home purchases. However, if the funds later return to the parents' account, or if the parents actually retain control, causing a break or discontinuity in the cash flow, it may cause issues in asserting later that these funds were the children's own money for home purchases. If only part of the house payment cannot be proven, it's not necessarily considered a gift in its entirety. Suppose the father and son agree on a house sale price of 10 million won. If the son can prove that 7 million won of it actually came from his own savings, salary, or other legal funds, but cannot provide concrete proof for the source of the remaining 3 million won, it does not mean that the entire 10 million won will necessarily be considered a gift. According to relevant interpretations by the Ministry of Finance, for property sales between relatives within the second degree of kinship,

Selling a House to Your Son, Even with Payment, Might Still Be Considered a Gift! Tax Bureau Checks 'Where the House Money Came

Parents who want to transfer property to their children don't always do it through a direct 'gift.' Some families opt for a sales transaction. Suppose a father sells his house to his son for 10 million won, they sign a sales contract, and the son actually transfers 10 million won from his account to his father's. It seems like a legitimate sale with payment and title transfer. However, under current tax law, there's a rule for property transactions between close relatives that doesn't apply to unrelated buyers: the tax bureau doesn't just look at 'whether the money was transferred,' but also verifies 'where the funds for the property came from.' Why might selling a house to a son, even with payment, be considered a gift? The key lies in Article 5 of the "Estate and Gift Tax Act." According to current regulations, property sales between relatives within the second degree of kinship are generally treated as gifts. However, if the buyer can provide concrete proof of payment, and if this payment was not a loan from the seller to the buyer, nor borrowed from a third party with the seller as guarantor, then the transaction can be proven to be a genuine sale and not a gift. Therefore, when a father sells a house to his son, even if the son can present bank records showing the 10 million won transferred to the father's account, they must further prove that the source of these funds complies with the regulations. Can a son use his own salary or savings to buy his father's house? It's not automatically considered a gift when parents sell a house to their children. If the son genuinely has the financial capacity to purchase the property, for example, by using long-term accumulated salary, savings, investment income, or other personal assets to pay the property price,

Love is never a straight and smooth path, but a long and gentle practice. We often say 'love is instinct,' but only after truly entering a relationship do we realize that learning how to love and how to be loved is a course that requires a lifetime of study. 1. About Meeting: The most beautiful thing isn't perfection, but someone who understands you just right. In a sea of people, the collision of two hearts is a miracle in itself. 'Being together isn't about finding someone flawless, but about seeing the most authentic and lovable version of yourself, with all defenses down, through the other person's eyes.' The best relationships don't require forced pleasing or stretching to fit. You can laugh out loud or cry your heart out in front of them; their presence finally gives you a safe harbor to anchor in a noisy world. 2. About Adjustment: Falling in love is easy, but living together requires humility and hugs. The initial thrill of passionate love eventually fades into normalcy, often followed by the trivialities of daily life and clashes of personality. 'Angry words during a fight are like nails hammered into wood; even after they're pulled out, the wound remains. True maturity is not hurting the other person's heart during arguments and not compromising your soul when you yield.' When two people walk together, friction is inevitable. Knowing when to give each other a way out when angry, and to proactively extend your hands after a dispute, isn't about who wins or loses, but because in each other's hearts, 'this relationship' is always more important than 'winning an argument.' 3. About Letting Go and Growing: Wrong people teach us to cherish, right people walk with you to the end.

Three Days Off: Ideal vs. Reality

The mental preparation before a long holiday often has a huge gap with the actual execution. This image perfectly illustrates the 'ideal vs. reality' for modern people during their days off. The anticipated holiday is a soul-cleansing epic journey. Like the boy in the picture wearing an explorer's hat, carrying a backpack, and striding forward in the sun, with tents and green trees in the background. It's an ambition for 'revenge travel outdoors,' as if three days are enough to conquer mountains and embrace nature, completely breaking free from office constraints. However, the actual holiday turns into a physics demonstration of 'mattress gravity.' The explorer's hat becomes an eye mask, and the backpack is replaced by a pillow. The boy, in pajamas, lies listlessly on a green mattress, protesting with 'zzZ.' Potato chips, a smartphone, and a TV remote scattered around form the entire universe of the holiday. Where's the promised sunshine? Blocked by the curtains. Where's the promised outing? Spent entirely on binge-watching and zoning out. This huge disparity actually stems from the accumulated fatigue of daily life. For most people, the true meaning of a holiday isn't 'exploring the world' but 'restoring body and mind.' The first day evaporates in catching up on sleep, the second day is lost scrolling through phones, and the third day is spent reluctantly with the mattress amidst the anxiety of 'going back to work tomorrow.' Ultimately, the holiday is a process of devolution from an 'outdoor adventurer' to an 'ultimate couch potato.' Although unproductive, looking at the scattered snack wrappers and remotes, this might be the most luxurious and realistic holiday philosophy of our time. This is how the 'couch potato' is born🤣🤣
