Accused of Fraud After Being Scammed for $50,000, 'David' Beats 'Goliath' as Telecom Company Loses Lawsuit
A small-value payment fraud of $5,000 led a major telecom company to sue its victimized customer. Ms. Chen from Tainan received her bill last October and discovered that on September 28th, she had allegedly made a $5,000 in-app purchase for 'Lineage 2M' game currency via her mobile phone. However, she doesn't play this game at all. She immediately rushed to the Jiali Police Station to report the incident and, armed with the police report, informed the telecom company that she refused to pay the wrongful charge. Despite the police report, the telecom company insisted that the bill was under her number and must be paid. When their demands went unheeded, they sued her for $5,000 based on the telecom service agreement. After reviewing the case, the judge found that the IP address used for the mobile authentication of this charge was in Hong Kong. The game was developed in Korea, and there is no official distributor in Taiwan, making it impossible for the police to track the actual user. More critically, the only evidence the telecom company could present was a contract renewal agreement and a payment notice. They failed to provide any valid proof of whether Ms. Chen was the player or had made the purchase. The judge pointed out, 'For $5,000, who would risk being accused of filing a false report and spend time and effort going to the police station and court?' Ultimately, the court dismissed the telecom company's lawsuit, and Ms. Chen did not have to pay a single cent. This case highlights how small-value payment fraud via telecom services has become a common consumer dispute, and the big corporations' standard operating procedure of 'sue first and gamble they'll be too bothered to fight back' finally hit a wall. Consumers who experience such fraud must report it to the police immediately and keep the police report. Do not simply pay up because the amount is small. It's already unlucky to be scammed, and then to be forced to pay for it. $5,000 isn't a small amount for an average person, so it's fortunate the woman didn't have to pay in the end 😑

It's truly outrageous that telecom companies abuse judicial resources over a few thousand won. Fortunately, the truth came out, and this serves as a reminder that when facing unclear bills, gathering evidence and reporting to the police immediately is essential to protect your rights.

I wouldn't go to court over a small matter, it's a waste of time.

The amounts for fraudulent charges through telecom usually aren't too high. The highest I've seen for a small amount was around 20,000 (KRW), and it's true that most people don't want to spend the time and effort to go to court.

Victims of scams are always the vulnerable ones. If the amount isn't large, many give up because it's too much hassle. There are many such people in society. For example, when a restaurant business gets scammed, owners often choose to let it go to avoid 'high time costs' and 'maintaining their reputation', fearing trouble. This allows some people to get a taste of it and repeat their offenses. What a mess in a cash-based society 🧐🧐🧐
